Terms of Service

Clear expectations for website use, sample development, and custom apparel projects.

Last updated: October 20, 2026

01 · About These Terms

These Terms of Service apply to your use of mxcustomclothing.com and explain the general framework for working with MX Clothing on custom apparel projects.

Project-specific details—including specifications, prices, payment schedules, delivery terms, and remedies—must be confirmed in the quotation, invoice, purchase order accepted by both parties, or separate written agreement. If these terms conflict with an expressly agreed project term, the agreed project term takes priority to the extent permitted by applicable law. Nothing here limits rights that cannot lawfully be excluded.

02 · Our Services

MX Clothing supports custom apparel development for fashion brands, private labels, startups, and business buyers. Services may include fabric and trim sourcing, sampling, printing, embroidery, labels, packaging, bulk production, quality review, and shipping coordination.

Website images and descriptions illustrate our capabilities. They do not guarantee that a particular material, technique, product, or production slot is available. Availability and suitability are confirmed for each project.

03 · Inquiries, Quotes & Order Confirmation

Submitting an inquiry or uploading a file is a request for project review. It does not itself confirm an order, reserve production capacity, or create an obligation to manufacture.

Please provide accurate contact details, references, quantities, measurements, fabric requirements, artwork, and delivery needs. Quotations are based on the information reviewed and may change if specifications or quantities change. Quote validity, currency, included services, and any excluded charges should be stated in the quotation.

Orders proceed after both parties confirm the relevant commercial and production requirements in writing and complete any agreed prerequisites, such as payment or sample approval.

04 · Minimum Quantities & Sampling

Minimum order quantities depend on the style, color, fabric, decoration, and sourcing requirements. The MOQ confirmed in your quotation applies to your project. Any exception must be agreed in writing.

Samples are used to review fit, fabric, construction, decoration, and finishing before bulk production. Sample charges, shipping costs, and revision scope must be agreed before sampling begins. Sample fees are eligible for credit toward a bulk order only when the bulk order reaches at least 200 pieces per style per color. Quantities from different styles or colors do not combine to meet this threshold. The credit details must be confirmed in the quotation or written order agreement. A sample fee is not automatically refunded unless this is agreed or required by applicable law.

Please review samples and specifications carefully. Approval should clearly identify the accepted sample and any remaining changes. Approval does not excuse goods that fail to meet the agreed specifications.

05 · Specifications, Approval & Changes

The agreed tech pack, size chart, approved sample, artwork, material details, and written revisions form the basis of production. Please resolve inconsistencies before approval.

Colors shown on screens may differ from physical materials. Where color accuracy is important, agree on physical swatches, lab dips, or another clear reference. Any permitted measurement, color, fabric, or finishing tolerances should be confirmed in writing before production.

Changes requested after approval may affect material availability, price, and delivery. We will review the request and confirm any revised cost or schedule before proceeding. Some changes may no longer be possible once materials have been ordered or production has started.

06 · Pricing & Payment

Payment methods, deposit requirements, balance due dates, and bank or transaction charges are set out in the agreed quotation or invoice. No fixed deposit percentage is established by this page.

Unless expressly included in the quotation, shipping, insurance, import duties, taxes, customs charges, testing, and certification are not assumed to be included. These costs and responsibilities should be confirmed before ordering.

Missing agreed payments or approvals may affect the production schedule. If payment instructions change unexpectedly, verify them through a previously confirmed contact channel before transferring funds.

07 · Production & Delivery

Website lead times are general estimates. Your project schedule depends on confirmed specifications, material availability, payment, approvals, order volume, and production complexity. Any binding delivery commitment must be expressly agreed in writing.

Shipping method, destination, delivery responsibilities, customs arrangements, and any agreed Incoterms rule and named place should be confirmed for each order. Production lead time and transit time are separate.

If a material delay arises, we will communicate with you about the effect on your project and the available next steps. Delays outside a party’s reasonable control will be handled under the order agreement and applicable law; they do not automatically remove all contractual responsibilities.

08 · Quality Questions, Cancellations & Returns

Please inspect your shipment promptly and contact us if you believe there is a shortage, damage, or a departure from agreed specifications. Include your order reference, a description of the issue, affected quantities, and clear photos or videos. Keep the affected goods and packaging available for review.

We will review the evidence against the agreed order requirements and discuss an appropriate resolution. Depending on the circumstances, agreement, and applicable law, this may involve repair, replacement, credit, refund, or another agreed remedy.

Custom goods are made for a specific project. Cancellation, change-of-mind returns, and refunds depend on the agreed terms, work already completed, committed material costs, and applicable law. This does not exclude remedies for defective or nonconforming goods. Please contact us before returning goods so return arrangements can be agreed.

09 · Artwork, Ownership & Confidentiality

You must own or have permission to use the designs, logos, photographs, text, and other materials you provide. We may decline requests that appear to infringe another party’s intellectual property rights.

You retain rights in your existing materials. You authorize us to use and share them with relevant project personnel and production partners only as needed to review and fulfill your request. Ownership and delivery of newly created patterns, source files, tooling, or other development work should be agreed separately in writing.

Any confidentiality agreement and any permission to display your brand, designs, or finished project in marketing should be agreed separately. Submitting materials does not itself grant permission for public promotional use.

10 · Responsible Website Use

Please use the website lawfully. Do not upload malicious files, submit fraudulent inquiries, interfere with website operation, attempt unauthorized access, or misuse other people’s personal information or intellectual property.

Website content belonging to MX Clothing or its licensors may not be reproduced for commercial redistribution without permission. External links, including messaging services, are governed by the relevant provider’s terms.

We aim to keep website information accurate and available, but errors or interruptions may occur. Please confirm important product and order details directly with our team.

11 · Questions, Disputes & Updates

If a concern arises, contact us with the relevant project records so we can work toward a practical resolution. Any agreed governing law, court jurisdiction, or arbitration arrangements should be set out in the order agreement. These website terms do not establish a separate arbitration requirement or override mandatory legal protections.

We may update these terms and will show the revised date on this page. An update does not automatically change an existing confirmed order; changes to an existing order require agreement or another valid legal basis.
